### Can I sue my employer for a construction accident?
Usually not. In most states workers' compensation is the exclusive remedy against your own employer, which means comp benefits replace a lawsuit. Narrow exceptions exist in some states, such as for intentional harm. You can often sue other companies on the site, such as the general contractor, a subcontractor or an equipment maker.

### What is a third-party construction accident claim?
It is a lawsuit against someone other than your employer whose negligence contributed to your injury. Common third parties include general contractors, other subcontractors, property owners, equipment manufacturers and rental companies, and drivers of vehicles on or near the site.

### Can I get workers' comp and also file a lawsuit?
Often yes. Workers' comp pays medical bills and part of lost wages regardless of fault, and a third-party lawsuit can recover the losses comp does not cover, including pain and suffering. The comp insurer usually has a lien on part of the lawsuit recovery for what it paid.

### Does an OSHA violation prove the contractor was negligent?
Not automatically, but it can be strong evidence. Courts in many states let juries consider OSHA violations as evidence of negligence, and some treat them more strongly. OSHA itself does not pay compensation to injured workers; its role is inspections, citations and penalties.

### What should I do after a construction site injury?
Get medical care, report the injury to your employer in writing, and keep records of who was working where, what equipment was involved and who supervised the work. Photographs of the scene and the names of witnesses are valuable because job sites change quickly.
